Terms of Service

Welcome to Elevate Outdoors. By accessing our website, making a booking, or joining any trip, event, or adventure organised by Elevate Outdoors Kenya ("Elevate Outdoors", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before booking.

These Terms apply to all visitors, clients, and participants. If you do not agree to any part of these Terms, please do not use our services.

1. Bookings and Reservations

1.1 How Reservations Work

Submitting a reservation form on our website constitutes a request to join a trip, not a confirmed booking. A booking is only confirmed once you receive written confirmation from Elevate Outdoors and the applicable deposit or full payment has been received.

1.2 Accuracy of Information

You are responsible for ensuring that all personal information provided during the booking process is accurate and complete. Elevate Outdoors accepts no liability for losses arising from inaccurate information supplied by the client.

1.3 Group Bookings

Where a booking is made on behalf of a group, the person making the booking accepts these Terms on behalf of all group members and is responsible for ensuring all members are aware of and comply with these Terms.

2. Payment

2.1 Pricing

All prices are quoted in Kenyan Shillings (KSh) unless otherwise stated, and are per person unless explicitly noted. Prices include the items listed in the trip description under "What's Included" and exclude items listed under "Not Included".

2.2 Payment Terms

Payment details and deadlines will be communicated at the time of booking confirmation. Elevate Outdoors reserves the right to release a reserved spot if payment is not received by the agreed deadline.

2.3 Price Changes

Elevate Outdoors reserves the right to adjust prices at any time for new bookings. Confirmed bookings will not be subject to price increases unless there are exceptional circumstances beyond our control, such as significant fuel price increases or government-imposed levies, in which case we will give reasonable notice.

3. Cancellations and Refunds

3.1 Cancellation by the Client

All cancellations must be submitted in writing to hello@elevateoutdoors.com. The following cancellation policy applies:

• More than 14 days before the trip: full refund less any non-recoverable costs already incurred.
• 7–14 days before the trip: 50% refund.
• Less than 7 days before the trip: no refund.
• No-show on the day: no refund.

3.2 Cancellation by Elevate Outdoors

Elevate Outdoors reserves the right to cancel or reschedule a trip due to insufficient bookings, unsafe conditions, or circumstances beyond our control. In such cases, affected clients will be offered a full refund or the option to transfer their booking to a future trip. Elevate Outdoors is not liable for any additional costs (e.g. travel, accommodation) incurred by clients as a result of a cancellation.

3.3 Force Majeure

Elevate Outdoors shall not be liable for any failure to perform its obligations where that failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, public health emergencies, or civil unrest.

4. Health, Safety, and Participant Responsibility

4.1 Fitness and Health

Participants are responsible for assessing their own fitness and health before joining a trip. Each trip lists a difficulty level. By booking, you confirm you are physically and medically capable of completing the activity. Elevate Outdoors reserves the right to exclude a participant from a trip if, in the guide's judgment, participation poses a risk to the individual or others.

4.2 Medical Conditions

You must disclose any relevant medical conditions, allergies, or dietary requirements at the time of booking. Elevate Outdoors will treat this information confidentially and use it only to ensure your safety.

4.3 Conduct

All participants are expected to behave respectfully toward guides, fellow participants, wildlife and local communities. Elevate Outdoors reserves the right to remove from a trip, without refund, any participant whose behaviour is deemed unsafe, disruptive, or disrespectful.

4.4 Guide Authority

Our guides have final authority on all safety decisions during a trip. Their instructions must be followed at all times. Elevate Outdoors accepts no liability for injury or loss arising from a participant's failure to follow guide instructions.

5. Liability and Indemnity

Outdoor activities carry inherent risks. While Elevate Outdoors takes all reasonable precautions to minimise risk, participation is at your own risk. By booking with us, you acknowledge and accept these risks.

To the fullest extent permitted by Kenyan law, Elevate Outdoors shall not be liable for any personal injury, death, loss, or damage to property suffered by a participant, unless caused by the proven negligence of Elevate Outdoors or its staff.

You agree to indemnify Elevate Outdoors against any claims, costs, or damages arising from your own negligence, breach of these Terms, or failure to disclose relevant health information.

6. Insurance

Elevate Outdoors strongly recommends that all participants take out comprehensive travel and activity insurance before joining any trip. This should cover, at minimum: personal accident, medical expenses, emergency evacuation, and trip cancellation. Elevate Outdoors does not arrange insurance on behalf of participants.

7. Intellectual Property

All content on this website — including text, photographs, graphics, and branding — is the property of Elevate Outdoors and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our express written permission.

By participating in an Elevate Outdoors trip, you grant Elevate Outdoors a non-exclusive, royalty-free licence to use photographs or video footage in which you appear for marketing and promotional purposes, unless you notify us in writing that you do not consent.

8. Website Use

This website is provided for informational and booking purposes. You agree not to use it for any unlawful purpose or in any way that could damage, disable, or impair the website. Elevate Outdoors makes no warranty that the website will be uninterrupted, error-free, or free of viruses.

Links to third-party websites are provided for convenience only. Elevate Outdoors has no control over and accepts no responsibility for the content of external sites.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the Kenyan courts.

10. Changes to These Terms

Elevate Outdoors reserves the right to update these Terms at any time. Changes will be published on this page with an updated date. Your continued use of our services after any changes constitutes acceptance of the revised Terms.
